1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of Poster.fm ("poster.fm", "we", "us", or "our") and its services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, you must not use the Service.
The Service is intended for a general audience. By using the Service, you represent that you are at least 13 years old. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian.
2. Description of the Service
The Service provides a web-based tool that allows users to search for album-related information, generate poster-style designs, customize visual elements, and download resulting images.
The Service may use music-related data obtained from third-party providers, including but not limited to album artwork, artist names, track listings, and associated metadata.
3. User Accounts and Sessions
The Service does not require account registration. Instead, an anonymous session may be created to enable functionality such as saving temporary data, preferences, or uploaded content.
You are responsible for activity conducted through your use of the Service and for maintaining the integrity of your device, browser environment, and session access.
4. Permitted Use
You may use the Service solely for personal, non-commercial purposes unless we expressly authorize otherwise in writing. You agree to use the Service in compliance with all applicable laws, regulations, and third-party rights.
You are solely responsible for ensuring that your creation, download, sharing, printing, or other use of generated content complies with copyright, trademark, publicity, privacy, and other applicable laws.
5. Intellectual Property and Third-Party Content
The Service may display, incorporate, or make available third-party content, including but not limited to album artwork, artist names, logos, track listings, and music-related metadata. All such content remains the property of its respective owners and may be protected by copyright, trademark, and other applicable laws.
We do not claim ownership of third-party content made available through the Service. The inclusion of such content does not grant you any license, ownership interest, or other right to use that content beyond what is permitted by applicable law or by the rights holder.
Subject to the rights of third parties in any incorporated materials, you retain ownership of original content you upload and your original creative contributions to designs you create using the Service.
6. User-Generated Content
By uploading, submitting, or creating content through the Service, you represent and warrant that you have all necessary rights, licenses, permissions, and authority to use that content in connection with the Service.
You agree not to upload, generate, or distribute content that:
- Violates any applicable law or regulation
- Infringes or misappropriates any intellectual property, privacy, or publicity right
- Is fraudulent, defamatory, obscene, abusive, hateful, or otherwise objectionable
- Contains malicious code, malware, or other harmful components
7. Prohibited Activities
You agree not to:
- Use the Service for commercial purposes without our prior written authorization
- Copy, reproduce, scrape, harvest, or extract data from the Service except as expressly permitted
- Reverse engineer, decompile, or attempt to discover source code or underlying systems
- Interfere with, disrupt, overload, or compromise the operation or security of the Service

We do not warrant that the Service will meet your requirements, that outputs will be accurate or complete, or that defects will be corrected.

To the fullest extent permitted by law, Poster.fm and its operators, affiliates, licensors, service providers, and representatives will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your access to or use of, or inability to access or use, the Service.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed one hundred U.S. dollars (US$100).
Your use of the Service is at your sole risk.
12. Indemnification
You agree to defend, indemnify, and hold harmless Poster.fm and its operators, affiliates, service providers, and representatives from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees, including reasonable attorneys' fees, arising out of or relating to your use of the Service, your content, your violation of these Terms, or your violation of any law or third-party right.
13. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, applicable law, or the rights of others, or if your use of the Service could create risk or liability for us.
Sections of these Terms that by their nature should survive termination will survive, including without limitation provisions relating to ownership, disclaimers, limitations of liability, indemnification, and governing law.
14. Changes to These Terms
We may revise these Terms from time to time. Updated Terms will become effective when posted on this page unless otherwise stated. Your continued use of the Service after revised Terms are posted constitutes your acceptance of the updated Terms.
15. Governing Law
These Terms and any dispute arising out of or relating to these Terms or the Service will be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.
